Combating Unfair Competition and Unfair Marketing Practices Via Switzerland

The Swiss authorities are aware that some companies/individuals use Switzerland as a base for dubious business practices. Switzerland has no wish to be regarded as a “loophole” or “hideout” for criminals or companies/individuals misleading the public. Switzerland is implementing measures to prevent, find and prosecute individuals and companies engaged in such unethical practices.

Types of scams

  • Unfair practices arise most frequently in connection with trade in all types of directories, e.g. business directories, fax listings, trademark-and patent registers, mail order trading of pseudo products, sweepstakes, financial transactions and time-shares.
  • Get-rich-quick schemes: Companies which claim to be located in Switzerland, promise the target groups a specific amount of profit. As a contribution toward its expenses, the company demands an amount in dollars.
    The following companies have already been reported to the competent Swiss authorities in charge of investigating fraud:

  • OVAG International AG
  • Premium Recovery AG

Other Companies

  • Fédération Internationale d’Attribution de Gains, F.I.A.G., Lausanne
    Arlimbows, Genève
  • Department of International Settlements, Basel

The companies/individuals mentioned in the downloaded document are mistakenly claiming to be located in Switzerland.  Please refer to the link "types of scams" on the right side of this page.

Why Switzerland?

Switzerland enjoys a good reputation as an international business location. Many headquarters of international companies and organisations are based in Switzerland.

What are the Swiss authorities doing to counter these scams?

One of their tasks is to enforce the Swiss Fair Trading Act. In this context, the State Secretariat for Economic Affairs (seco) has taken legal action and launched criminal proceedings against several companies/individuals. These cases are currently pending in court.

It has come to the attention of the Embassy, that there is a very aggressive selling taking place in Malaysia to promote an investment fund scheme called

Swiss Cash
or
Swiss Mutual Fund 1948

Every serious Internet User is aware of the fact, that anything can be said, promised and advertised on the Internet completely uncontrolled. There is a tremendous amount of good and useful information, but unfortunately the Internet is also a breeding place of a lot of misleading sometimes even fraudulent information. It is therefore always wise to do some research.

The Swiss Mutual Fund (1948) and or Swiss Cash are not registered companies in Switzerland. Until proof of the contrary, the Embassy doubts that the remarks about these funds and their historic links to Switzerland as outlined on their original website are genuine. The original website is indeed registered in the USA and the contact telephone number is from New Jersey (USA).

It is obvious that this company uses the denomination "Swiss" in an illegal and fraudulent way to attract customers.

Moreover, the promotion of the fund seems to work via agents on a MLM system which appears to be close to a Pyramid scheme. Pyramid schemes are illegal in Switzerland.

The Embassy does therefore not recommend these funds as an investment opportunity.
